Article 1 – Definitions

Stress to Strength: Natasha Kalidin Coaching Services & Products, located in Zaandam, Chamber of Commerce number 75089637.
Client: The individual or entity with whom Stress to Strength has entered into an agreement.
Parties: Stress to Strength and the Client together.
Consumer: A Client who is also an individual acting as a private person.

Article 2 – Applicability

These terms and conditions apply to all quotes, offers, work, orders, agreements, and deliveries of services or products by or on behalf of Stress to Strength.

Stress to Strength and the Client can only deviate from these terms if agreed upon in writing. The Client’s or other third-party terms are explicitly excluded.

Article 3 – Prices

Stress to Strength applies prices in euros, including VAT and excluding any additional costs unless agreed otherwise in writing. Prices may be subject to change at any time. Deviations from the standard price up to 10% are allowed, and the Client will be notified of larger deviations. The Client can waive the part above +10%. Annual price adjustments will be communicated in advance. Consumers may cancel if dissatisfied with price increases.

Article 4 – Payments and Payment Terms

Stress to Strength may request a down payment of up to 50% upon entering into the agreement. Payment after delivery must be made within 10 days. Payment terms are final. Stress to Strength may require immediate payment or security.

Article 5 – Consequences of Late Payment

  • Legal interest is due from the day the Client is in default.
  • Extrajudicial collection costs and damages are due.
  • Stress to Strength may suspend obligations in case of payment arrears.
  • Claims become immediately due in the event of liquidation, bankruptcy, etc.
  • In case of refusal to cooperate, the Client remains obligated to make payment.

Article 6 – Right of Withdrawal

A consumer may cancel an online purchase within 14 days without giving a reason, except for exceptions such as accommodation, travel, emergency repairs, etc. The cooling-off period starts when the agreement is concluded or when digital content delivery is confirmed. Cancellation must be done via email or the form on the website.

Article 7 – Right of Suspension

The Client (who is not a consumer) waives the right to suspend obligations.

Article 8 – Set-Off

The Client (who is not a consumer) waives the right to set-off.

Article 9 – Insurance

The Client must insure delivered items in their possession against damage, fire, and theft. Upon request, the insurance policy must be shown.

Article 10 – Guarantee

For services, there is an obligation of effort, not a result obligation.

Article 11 – Execution of the Agreement

Stress to Strength will perform the work to the best of its ability and may involve others. Execution occurs after approval and possible down payment. The Client must ensure the feasibility of the work in time; otherwise, additional costs will be for the Client’s account.

Article 12 – Information Provision by the Client

The Client must provide timely and accurate information. In case of negligence, and any resulting delays, additional costs will be for the Client’s account.

Article 13 – Duration of the Service Agreement

The agreement lasts for 4 months unless otherwise agreed. After that, it is automatically extended for an indefinite period, with termination notice periods of 2 months (1 month for consumers).

Article 14 – Termination of Service Agreement for a Fixed Period

The Client may terminate only after 1 year, with a notice period of 2 months (1 month for consumers). Shorter agreements cannot be terminated prematurely.

Article 15 – Intellectual Property

Stress to Strength retains intellectual property rights to all materials and designs. Use or distribution without written permission is prohibited.

Article 16 – Confidentiality

The Client must keep all confidential information secret. This duty remains in effect even after the agreement ends (for up to 3 years). Exceptions apply for public or legally required disclosure.

Article 17 – Penalty Clause

If the Client violates the terms regarding confidentiality or intellectual property, they must pay a fine to Stress to Strength. (Full text to be completed here)
